3. WHO IS RESPONSIBLE FOR YOUR ORDERS
(a) Orders for the UK.
All orders placed through this website which are to be delivered in the United Kingdom will remain and be fulfilled by us.
(b) Orders for delivery addresses in the European Union, Switzerland, Iceland, Norway or Liechtenstein
All orders placed through our website which are to be delivered within the EU or Switzerland shall be passed to and fulfilled by Penhaligon’s , S.A.R.L. (Penhaligon’s ) who is our authorised distributor in Europe and Switzerland. Penhaligon’s is a limited liability company entered in the Paris Commercial Register under no. 805 372 653, and with a registered office located at 1, rue Charles Tellier, Zone Industrielle de Beaulieu, 28000 Chartres. Our VAT number is FR67 805372653.

5. OUR PRODUCTS

8. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US AND HOW TO PAY
(a) Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order before submitting it.
(b) To place an order for products on this website, you should:

Step 2 – Enter the bag and choose Proceed to Purchase
Step 3 – Existing Customers: Sign in to your online account
New customers: Press continue, provide your contact information and billing and delivery addresses
Step 4 – Select Delivery Method and any Gift Message or Wrapping
Step 5 – Select Proceed to Purchase or Pay with Paypal
By clicking "Place my Order" you confirm that you have read, understood and accept these terms and conditions.
(c) Where your order is to be delivered within (a) European Union, Switzerland, Iceland, Norway or Liechtenstein then it will be passed to Penhaligon’s to fulfil and therefore references to “we” in the following sections means Penhaligon’s unless not applicable.
(d) You can pay for products on our website using a debit or credit card or PayPal, Apple Pay or Klarna.
(e) We or Penhaligon’s (where applicable) will take full payment for your order (including any delivery charges) on dispatch of the ordered products.
(f) Where you select ‘Proceed to Payment’, all credit/debit card transactions on our website are processed using a secure online payment gateway that encrypts your card details and cannot be accessed by us or Penhaligon’s .
(g) If you wish to pay for the products using PayPal, select ‘Pay with PayPal’ and you will be redirected to the PayPal login page to complete the payment of the order. If you do not have a PayPal account, you can sign up at the PayPal login page before completing your order.
(h) After you place an order, you will receive an e-mail from us acknowledging that we have received your order. This does not mean that your order has been accepted.
(i) We will confirm our acceptance of your order by sending you an e-mail that confirms that the products have been dispatched (‘Shipping Confirmation’). It is at this point that the contract between you and us for the sale and purchase of the products ordered by you will be formed and become binding. The contract that is formed shall be in English and will include these terms and conditions.
(j) If we are unable to supply you with a product, for example because that product is not in stock or no longer available or because of an error in the price or description on our website (see paragraph 13(d)) or because we are unable to obtain authorisation for your payment, we will inform you of this by e-mail as soon as possible and we will not process your order. If you have already paid for the products, we will refund you the full amount paid as soon as possible.
(k) We can choose not to accept an order from you for any products.
9. OUR RIGHT TO MAKE CHANGES
(a) Minor changes. We (but not Penhaligon’s ) may update or amend these terms from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements, and changes in our system' s capabilities. These changes will not affect your use of the product.
(b) More significant changes. Where we make changes to these terms or to the products and such changes affect your rights under these terms or your use of the products in any material way you will be notified when the relevant changes take effect. You may then end the contract before the changes take effect and receive a refund for any products you have paid for but have not yet received.
10. OUR RIGHT TO END THE CONTRACT
(a) We may end the contract if you break it. For example, where: you do not pay us any sum when due and still do not make payment within 14 days of us reminding you that payment is due, or you seek to order Products which you are not eligible to order (for example where the sale is confined to our employees only and you are not an employee).
(b) You must compensate us if you break the contract. If we end the contract in the situations set out in above we will refund any money you have paid in advance for the product(s) we have not provided but we may deduct from that refund or charge you reasonable compensation for the net costs we will incur as a result of you breaking the contract.
(c) We may withdraw the product(s). We may write to you to let you know that we are going to stop providing the product(s). We will let you know in advance of our stopping the supply of the product(s) and will refund any sums you have paid in advance for the product(s) which will not be provided.
11. YOUR RIGHT TO CHANGE YOUR MIND AND OUR PENHALIGON' S PROMISE
We offer our customers (aside from business accounts) who purchase products through our website for deliveries to addresses in the UK and Europe a Penhaligon’s Promise, and for deliveries to addresses within the EU and Switzerland, Norway, Iceland and Lichtenstein the Penhaligon’s Money Back Guarantee. This is more generous than your rights as a consumer under law as highlighted in the table below (full details of our Penhaligon’s Promise for the UK can be found here and, within the EU, here. Full details of the Penhaligon’s Money back Guarantee can be found here. Please note you also have statutory rights in relation to the products as a consumer which are not affected by the Penhaligon’s Promise or the L’Artisan Money back Guarantee.
